The use of this website www.abanoritz.it (the “Website”), offered to you (the “User”) by SIRA S.r.l., headquartered at Monteortone, 19 – 35031 – Abano Terme PD Italy (“SIRA”), is subject to the Terms of Use. SIRA allows the User to access a wide range of resources on the Website (the “Resources”), including but not limited to:

  • Texts, graphics, sounds, images, descriptions, and Website layouts (collectively referred to as “Content”);
  • Products, services, communication tools, booking and/or purchasing systems for services or products, or other tools and services accessible through the Website (collectively referred to as “Services”);

The User may not (and may not allow anyone else to) modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, assign, sell, or attempt to obtain the source code of any Software, Services, Documentation, Content, or Publications obtained from the Website, unless expressly permitted or required by law, or unless specifically authorized in writing by SIRA.

The User agrees to be solely responsible for any breach of the User’s obligations under these Conditions of Use and for the consequences (including any loss or damage that SIRA may suffer) of any such breach.

Access to Services

SIRA has partners and suppliers; at times, these companies will provide the User with Services and Resources on behalf of SIRA. The User acknowledges and agrees that SIRA’s partners and suppliers shall have the right to provide the User with Services and Resources.

The User acknowledges and agrees that SIRA may discontinue (permanently or temporarily) the provision of Services and Resources (or any part thereof) to users in general at SIRA’s sole discretion, without prior notice to users.

Documentation Available on This Website

For any Software not accompanied by a License Agreement, SIRA grants the User a personal and non-transferable license to use the Software for the purpose of viewing and otherwise using this Website and related Services in accordance with these Conditions of Use, and for no other purpose. By installing, copying, or using the Software, the User agrees to be bound by the terms of this license.

Disclaimer of Warranty

The Website, Services, and all Resources are provided on an “as is” and “as available” basis, and SIRA, its partners, and suppliers make no warranties with respect to them to the User.

In particular, SIRA, its partners, and suppliers do not represent or warrant to the User that the use of the Website and Resources will meet any particular needs, that the use of the Website and Resources will be uninterrupted, timely, secure, or error-free, that any information obtained by the User as a result of using the Website, Services, and Resources will be accurate or reliable, or that defects in the operation or functionality of any kind provided as part of the Website will be corrected.

Language of the Terms

The Conditions of Use in the Italian language shall govern the User’s relationship with SIRA; the translation of the Conditions of Use is provided to the User for convenience only. In the event of any inconsistency between the Italian-language version and any translation, the Italian-language version shall prevail.

General Provisions

The User declares that the use of the Website and Resources does not create any joint venture, partnership, employment relationship, agency, or representation between the User and SIRA.

SIRA shall have the right, unlike the User, to assign, transfer, subcontract, or delegate rights, commitments, and obligations arising from these Conditions of Use.

The Terms of these Conditions of Use and the relationship between the User and SIRA shall be governed by Italian law, and any legal disputes arising from the Terms shall be subject to the exclusive jurisdiction of the Court of Padua.
